تتباين أحكام محاكم الأسرة في قضايا استضافة الأبناء بين القبول والرفض لغياب نص تشريعي صريح ينظمها.
تستند المحاكم في إقرار الاستضافة إلى توافق الطرفين أو تقدير المصلحة الفضلى للصغير وتوفير بيئة آمنة له.
يختلف مفهوم الاستضافة عن حق الرؤية القانوني الذي يتيح للأب رؤية أطفاله في أماكن محددة دون اصطحابهم للمبيت.
