حيثيات الإدارية العليا بمنح مواطن من ذوي الإعاقة بطاقة الخدمات المتكاملة

أصدرت المحكمة الإدارية العليا حكماً يقضي بأحقية مواطن من ذوي الإعاقة الحركية في الحصول على بطاقة الخدمات المتكاملة.
استندت المحكمة في حكمها إلى التقارير الطبية والمستندات التي أثبتت حالة الإعاقة لدى صاحب الشأن.
أكدت المحكمة على ضرورة التحقق الطبي والفني من حالات الإعاقة وعدم الاكتفاء بالتقدير الإداري المجرد.
أقرت المحكمة بوجوب إعادة بحث حالة صاحب الشأن بما يكفل له حقوقه القانونية عند وجود تقارير طبية تستوجب ذلك.

أودعت المحكمة الإدارية العليا بمجلس الدولة، حيثيات حكمها بإلغاء الحكم الصادر عن محكمة القضاء الإداري، والقضاء بأحقية أحد المواطنين من ذوي الإعاقة في الحصول على بطاقة الخدمات المتكاملة لأصحاب الهمم..
