هل يمكن إلغاء حكم إدانة نهائي بعد ظهور دليل جديد؟.. محكمة النقض توضح

ما يعرفه ريفو عن الخبر

  • أقرت محكمة النقض إمكانية إعادة النظر في الأحكام الجنائية النهائية عند ظهور أدلة جديدة تثبت براءة المحكوم عليه.
  • قضت المحكمة ببراءة متهمة في قضية تبديد إيصال أمانة بعد ظهور تقرير الطب الشرعي الذي أثبت تزوير المستند.
  • استندت المحكمة في قرارها إلى المادة 441 من قانون الإجراءات الجنائية التي تنظم حالات إعادة النظر في الأحكام الباتة.

هل تسقط الإدانة بعد ظهور دليل جديد؟.. حكم لمحكمة النقض يوضح ضوابط إعادة النظر في الأحكام الباتة، بعد ثبوت تزوير إيصال أمانة والاستناد إلى تقرير الطب الشرعي للقضاء بالبراءة.
