النقض تضع 3 مبادئ قضائية لتنظيم التصرفات في حقوق وأملاك ومال القاصر

ما يعرفه ريفو عن الخبر

أصدرت محكمة النقض ثلاثة مبادئ قضائية لتنظيم تصرفات الوصي في حقوق وأملاك ومال القاصر.
يُحظر على الوصي مباشرة التصرفات التي تنشئ حقوقاً عينية عقارية أو تنقلها أو تغيرها إلا بإذن المحكمة.
يفقد الوصي صفة النيابة إذا باشر تصرفات محظورة دون إذن، ولا تنصرف آثارها إلى القاصر.
يحق للقاصر التمسك ببطلان التصرفات التي أجراها الوصي دون إذن المحكمة عند بلوغه سن الرشد.
