الهيئة العامة للنقض: استطلاع رأي المفتي واجب أمام محاكم الجنايات بدرجتيها

ما يعرفه ريفو عن الخبر

أرست الهيئة العامة للمواد الجنائية بمحكمة النقض مبدأ وجوب استطلاع رأي مفتي الجمهورية أمام محاكم الجنايات بدرجتيها قبل إصدار حكم بالإعدام.
لا يغني سبق اتخاذ إجراء استطلاع رأي المفتي أمام محكمة أول درجة عن وجوب اتخاذه مجددا أمام محكمة الجنايات المستأنفة.
يعد استطلاع رأي المفتي شرطا لازما لصحة الحكم لضمان موافقته لأحكام الشريعة الإسلامية وطمأنة المتهم والرأي العام.
أقرت الهيئة بالإجماع الأحكام التي تلتزم بهذا المبدأ وألغت الحكم المخالف الصادر في الطعن رقم 11339 لسنة 94 قضائية.
