حظر الخمور وإغلاق البارات في رمضان.. ما السند القانوني لقرارات الحكومة؟

  • حجزت محكمة القضاء الإداري الدعوى رقم 41877 لسنة 79 قضائية للحكم بشأن مشروعية القرارات والكتب الدورية التي تفرض قيوداً موسمية على تقديم المشروبات الكحولية وإغلاق المنشآت الترفيهية.
  • تتمحور القضية حول مدى قانونية سلطة الحكومة في فرض قيود موسمية على المنشآت السياحية خلال شهر رمضان والمناسبات الدينية.
  • تستند التساؤلات القانونية إلى قانون حظر الخمور رقم 63 لسنة 1976 وقانون المنشآت الفندقية والسياحية رقم 8 لسنة 2022 لتحديد نطاق التراخيص والقيود الإدارية.
  • تحدد جلسة 28 نوفمبر المقبل للنطق بالحكم في القضية التي تهدف للتحقق من السند القانوني لقرارات الغلق والقيود المفروضة على المنشآت السياحية.

عاد ملف حظر بيع المشروبات الكحولية للمصريين وإغلاق البارات والملاهي الليلية خلال شهر رمضان والمناسبات الدينية إلى الواجهة، مع اقتراب موعد الفصل القضائي في الدعوى المطالبة بإلغاء القرارات
